Toby Graham – Partner at Farrer & Co
Toby is Farrer & Co's head of contentious trusts and estates. He is an expert in significant cross-border contentious trusts and estates. He is regularly involved in trust disputes before courts in England and overseas, including offshore jurisdictions and Switzerland. Toby is a distinguished contributor to key texts on wills and trusts (Trusts & Trustees published by OUP; STEP diploma in trust disputes; Money Laundering (Butterworths Compliance Series) and A Practical Guide to the Transfer of Trusteeships (3rd edition). An overview of how Swiss and English courts approach interests of beneficiaries of discretionary trusts in divorce proceedings, and what steps can be taken to protect such interests. Through “real life” examples, this presentation will explore issues of trust validity, applicable law, matrimonial regimes, jurisdiction and enforcement, with a particular emphasis on Anglo-Swiss situations.
